BC's cooling-off period, known as the Home Buyer Rescission Period (HBRP), gives you three business days after the seller fully accepts your offer to back out for any reason, paying only a 0.25% fee of the purchase price—no questions asked. Beyond that, include standard subjects in your offer to protect your deposit during due diligence, as the HBRP does not grant extra time for inspections or financing.
How the cooling-off period works
The three business days start the day after the seller signs acceptance of your offer, excluding weekends and statutory holidays. Notify the seller in writing (email or form suffices) to rescind, and pay the fee—$2,500 on a $1 million home—within 14 days; your deposit returns minus that amount. This applies to all residential sales (houses, condos, townhomes) including private deals, but not commercial or some pre-sale exceptions, and you cannot waive it.
Essential subjects to include
Subjects are buyer protections lasting 7–21 days, letting you exit penalty-free if conditions fail; waive them only after checks pass. Always include:
Financing subject: Confirms your mortgage approval meets terms (7–10 days).
Inspection subject: Allows a professional review of the property (5–10 days).
Strata documents review (if applicable): Time to study bylaws, minutes, financials, and depreciation report (7–14 days).
Title review: Ensures clear ownership, no liens or restrictions (handled by notary, often 3–5 days).
Property disclosure statement: Review seller's condition report for known issues.
Optional or situational subjects
Add these based on your deal:
Appraisal subject: Verifies value supports your price and loan.
Sale of current home: If selling first.
New home warranties or engineer review for older/unique properties.
Strategy tips
In buyer-friendly markets, extend subjects for thorough checks; in hot ones, shorten or waive strategically but keep HBRP as backup. Work with a realtor to draft clear timelines and notify clauses, and never remove subjects until your notary and lender greenlight.
